The role of insurance in tort law

Insurance plays an important role in tort law. The connection between insurance and tort law is evident in the fact that liability for damages is often transferred to the insurer through liability insurance, meaning that the party causing the damage is not solely liable for the damages.

However, insurance companies and policyholders do not always agree on if an insured event has occurred and how the liability for compensation should be divided. An insured event is an event that, according to the insurance contract and the terms and conditions of insurance, is intended to be compensated on the basis of the insurance.

We are experienced experts in insurance law

The terms and conditions of insurance contracts define the conditions for liability for compensation. However, not all terms and conditions are unambiguous, and insurance disputes often concern the interpretation of insurance policy terms and conditions. The application of different types of insurance, insurance contracts, and their terms and conditions to an accident is a matter of contract interpretation, and if an insurance company refuses to compensate for a loss, it is often a good idea to consult an insurance law expert if you have doubts about the correctness of the decision.

Corporate insurances

Our insurance lawyers have decades of experience in corporate insurance disputes and compensation matters.

Corporate liability insurance

Corporate liability insurance covers personal injury and property damage caused to third parties for which the company is liable, as well as any direct financial losses related to such damage.

Compensation is paid from the company’s liability insurance when the company is liable for the damage. If the insurance company considers that the company is not liable for the damage, it must, if necessary, compensate the legal costs incurred in defending against the claim for compensation.

If the company that caused the damage, such as a subcontractor, has liability insurance, the injured party may contest a negative compensation decision, even if it concerns another company’s liability insurance. The insurer must send the injured party information about its decision on the compensation claim made under the liability insurance. The injured party has the right to bring an action against the insurer on the basis of the compensation decision or to refer the matter to the Consumer Disputes Board or another similar body, if the matter otherwise falls within the competence of that body. This right applies to both consumers and businesses.
