Child custody and rights of access
The parents of a child or other persons who have been awarded custody of a child are the custodians of the child.
In principle, the custodians of a child are jointly responsible for the duties inherent in custody and make the decisions concerning the child together.
The purpose of child custody is to ensure the wellbeing and balanced development of a child in accordance with the child’s individual needs and wishes. A child shall be ensured good care and upbringing as well as supervision and protection appropriate for his or her age and stage of development.
The purpose of the right of access is to ensure that a child has the right to establish and maintain a positive and close relationship with the parent with whom he or she does not reside. The right of access includes the right of the child to visit this parent’s home from time to time or to meet with the parent somewhere else or to keep in touch with him or her in some other manner.
Child support
The child has the right to adequate support. The child’s parents are responsible for the child’s support to the best of their ability. The parents’ ability to support the child is assessed on the basis of factors such as their capacity to work, their ability to engage in gainful employment and the amount of resources available. A parent may be required to pay support to a child if, for example, the child is not permanently resident with him or her. The amount of support and the way in which it is to be paid shall be fixed by agreement or by a judgment.
